These Terms of Use ("Terms") are an agreement between you and DryverMedia LLC ("DryverMedia," "we," "us"), which operates The Top 10 Experts at thetop10experts.com (the "Site"). By using the Site, you agree to these Terms and to our Privacy Policy. If you don't agree, don't use the Site.
1. What the Site does
The Site is a free service that compares insurance, financial and home service providers and links you to providers' own websites, where you can get quotes, apply or buy.
DryverMedia is not an insurance company, agent or broker, a lender, a bank, a debt relief or tax resolution company, or a government agency. We do not sell insurance or financial products, make coverage, credit or underwriting decisions, or guarantee any rate, price or approval. Quotes, rates and terms come only from the providers. We are paid by many of the providers shown on the Site, which may affect which providers appear and their order, as explained in our Advertiser Disclosure and How We Rank page. You are never required to buy anything.
2. Who can use the Site
You must be at least 18 years old and a resident of the United States to use the Site.
3. Your information
You agree that information you submit through the Site is true and accurate. How we collect, use and share information is described in our Privacy Policy.
4. No professional advice
Rankings, scores, guides and other content on the Site are general information. They are not financial, investment, legal, tax, medical or insurance advice, and they may not reflect every product or offer available or the latest terms. Talk to a qualified professional about your own situation and confirm details with the provider before you buy.
5. Third-party offers and websites
Providers listed on the Site, and the websites you reach through our links, are run by independent companies. Your dealings with them, including any policy, loan or service you buy, are solely between you and them and are governed by their terms and privacy policies. We are not responsible for their products, services, content or practices.
6. Rules of use
You agree not to: submit false or fraudulent information; use bots, scripts or automated means to access the Site, click on listings or submit forms; interfere with or attempt to gain unauthorized access to the Site; copy or scrape the Site; or use the Site for any unlawful purpose.
7. Our content
The Site and its content, design, logos and code are owned by DryverMedia or its licensors and protected by intellectual property laws. You may use the Site for your personal, non-commercial use only. Other names and trademarks on the Site belong to their owners and do not imply endorsement.
8. Disclaimers
The Site is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We do not guarantee that you will receive any quote or offer, qualify for any product, or save money, or that the Site will be uninterrupted or error-free.
9. Limit of liability
To the fullest extent permitted by law, DryverMedia LLC and its owners, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss arising from your use of the Site or your dealings with any third party. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars ($100). Some states do not allow these limits, so they may not apply to you.
10. Indemnity
You agree to defend and hold harmless DryverMedia LLC from claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of the Site, your violation of these Terms, or your violation of anyone else's rights.
11. Disputes and arbitration
Please read this section carefully. It affects your legal rights.
You and DryverMedia agree to resolve any dispute relating to the Site or these Terms by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, instead of in court, except that either party may bring an individual claim in small claims court. You and DryverMedia each waive the right to a jury trial and to take part in a class, collective or representative action. The Federal Arbitration Act governs this section.
You may opt out of this arbitration agreement within 30 days of first using the Site by emailing legal@thetop10experts.com with your name, email address and the words "Arbitration Opt-Out."
These Terms are governed by the laws of the State of Nevada, without regard to conflict-of-law rules. Any matter not subject to arbitration will be brought only in the state or federal courts located in Clark County, Nevada.
12. General
We may change these Terms by posting a new version with a new effective date; changes apply to use of the Site after they are posted. If any part of these Terms is found unenforceable, the rest stays in effect. Our failure to enforce a provision is not a waiver. These Terms and the Privacy Policy are the entire agreement between you and us about the Site.
